Membership Terms
Agora KC Membership Agreement and Presale Terms
Effective September 30, 2026 · Version 1.0
This Agreement covers memberships purchased from KC Pickleball LLC, doing business as Agora KC ("Agora," "we" or "us"), at 12444 Grandview Road, Grandview, Missouri 64030. "You" means the member named in the purchase record.
Your purchase record identifies your membership tier and pricing option. This single Agreement covers both Pioneer and Founding Membership. Common terms apply to all members; Pioneer prices, benefits and tier-specific rules apply only to Pioneer. Section 15 supplies Founding pricing, benefits, renewal and cancellation terms and controls those subjects for Founding. We provide this Agreement before you purchase.
1 Membership eligibility and scope
Membership covers one named adult age 18 or older. Membership, included benefits and protected pricing cannot be sold, assigned or transferred. Any guest privileges are governed by your selected plan and applicable guest rules. Household and junior memberships, if offered, require separate terms. Guest and minor participation follows the applicable activity and waiver rules.
2 Plans and payment amounts
Pioneer pricing
| Plan detail | Pioneer 6 month | Pioneer 12 month |
|---|---|---|
| Initial commitment from access | 6 months | 12 months |
| Protected monthly rate | $84 | $79 |
| Payment due during presale | $84 | $79 |
| Application of presale payment | First month of member access | First month of member access |
| Later payments in initial term | 5 monthly payments of $84 | 11 monthly payments of $79 |
| Initial term membership dues | $504 | $948 |
| Renewal after initial term | Month-to-month at $84 | Month-to-month at $79 |
Pioneer has no additional enrollment or activation fee. A checkout label such as "signup fee" or "enrollment fee" refers to the first-month payment above, not an extra charge.
The stated membership prices include applicable taxes and payment-processing fees. There are no additional enrollment, activation, card-processing or other mandatory membership fees. Optional services, bookings and upgrades are charged only when separately purchased and authorized. The voluntary early-cancellation charge disclosed in Section 7 remains applicable where stated.
3 Presale reservation and the start of access
Your presale payment reserves your selected membership. Pioneer reservations also preserve the selected Protected Rate under Section 5. No additional recurring dues are collected while you wait for access. Your membership term and benefit allowances have not started.
Your Access Start Date is the date in your activation notice when regular member play is available and your tier's core facilities are usable. A tour, preview, account registration or payment does not start your term. Your first personal visit does not determine the start date.
Pioneer activation requires safe, legally usable pickleball courts, regular scheduled member open play, working restrooms and a functioning check-in and reservation process. Founding activation requirements are set out in Section 15.1. If a required facility is unavailable, the affected tier does not activate unless you expressly accept a written temporary arrangement stating the substitute access and any credit. Otherwise, your presale refund right remains available.
We will give at least seven calendar days' notice of activation, stating your Access Start Date, presale credit, next charge date, recurring amount and frequency, and initial term end date.
Your presale payment is not charged again at opening. Pioneer's next monthly payment follows the first paid access month. Founding payment and renewal terms are set out in Section 15. A provisional date or "active" account status in the membership platform does not start billing or access.
4 Presale cancellation and opening delays
You may cancel at any time before your Access Start Date for a full refund, without an early-cancellation fee. This includes your entire presale payment. A refund ends your reservation and any associated rate protection; rejoining uses the offer then available.
The outside access deadline is March 1, 2027. This is a refund-protection deadline, not a promised opening date. If access has not begun by then, we will cancel and refund your reservation unless you affirmatively accept an extension with a new deadline. Silence is not consent. An extension preserves your right to a full refund before access and any earlier statutory right.
If Agora abandons opening or cannot fulfill your reservation, we will cancel and refund it without waiting for the deadline. Construction, permitting and other delays do not remove these refund rights.
We will acknowledge refund requests within two business days and initiate refunds within five business days, normally to the original payment method. Agora absorbs processing fees. Bank posting time is additional, subject to any legal refund deadline. For these service standards, business days are Monday through Friday excluding federal holidays; Section 8 uses the statutory definition.
5 Pioneer protected rates and renewal
Your Pioneer Protected Rate is $84 or $79 per month for your selected option, including applicable taxes and processing fees. It stays the same throughout continuously maintained Pioneer membership, including renewals, even if standard prices increase. It is not limited to your initial commitment and does not create ownership or prepaid lifetime access. Founding pricing and renewal are governed by Section 15.
Pioneer automatically renews month-to-month after its initial six- or twelve-month commitment, at the same Protected Rate with no new minimum commitment. Renewal continues until cancelled under Section 7. This automatic-renewal authorization applies only to Pioneer.
Pioneer rate protection ends when cancellation takes effect or unpaid Pioneer membership lapses after the seven-calendar-day recovery period in Section 6. Stopping a future renewal does not change your rate during the remaining paid period. Rejoining uses the offer then available.
Changing tiers or pricing options requires a newly quoted rate and your express acceptance.
Benefits added to your tier become available under their stated terms. Added Pioneer benefits do not increase your Protected Rate. Partner offers and separately priced upgrades include only what their terms specify. Agora will not add an undisclosed mandatory fee to increase your agreed membership charge. Separate optional purchases are outside membership dues.
6 Payment authorization and failed payments
By accepting this Agreement and authorizing a Pioneer payment, you authorize the presale payment, the remaining initial-term monthly payments and monthly renewals described in Sections 2 and 5. No recurring charge is authorized while awaiting access or for a service period already paid. Founding payment authorization is governed by Section 15.3. Separate purchases require separate authorization.
Pioneer monthly billing falls on the monthly anniversary of the Access Start Date. If that date does not occur in a month, billing occurs on its last day and returns to the original anniversary date in the next applicable month. Membership months and benefit periods follow the same rule. No processing surcharge is added. Keep your payment method and contact details current.
After a failed Pioneer payment, we will notify you and allow seven calendar days from that notice to resolve it and preserve your Protected Rate. Access and existing reservations remain available during that recovery period. If unresolved, membership lapses, rate protection ends and future member reservations are cancelled with any separately prepaid booking charges refunded. Payment retries are limited to the amount due; duplicate collection is not authorized.
A failed payment does not erase amounts already owed or communicate cancellation. Early-exit charges remain limited by Section 7 or Section 15.2 for Founding. We will process revocation of payment authorization and membership cancellation as required by law.
7 Cancellation after access and no freezes
For Pioneer, send a cancellation request through a channel in Section 14 before the next renewal charge to stop renewal. Receipt determines timeliness, not staff processing time. We will confirm your end date and any final amount. Access continues through the paid period unless you request an earlier end or another provision lawfully requires it.
Pioneer: Voluntary cancellation during the initial commitment costs the lesser of $150 or remaining committed dues after the current paid month. No further future dues are owed; already-incurred dues and authorized purchases remain payable. Access continues through the paid month without proration. No early-cancellation charge applies before access, after the initial commitment, when stopping renewal only after completing that commitment, or where a penalty-free remedy is required.
Founding cancellation and refunds of its prepaid membership follow Section 15.2. Common presale refund rights in Section 4 and applicable legal protections remain available to both tiers.
No voluntary membership freezes are offered. Absence, travel or schedule changes do not pause dues or benefit periods. This does not limit legally required disability extensions, accommodations or other remedies.
8 BUYER'S RIGHT TO CANCEL
If Missouri's health-spa contract provisions apply, you may cancel without penalty through midnight of the third business day after signing. Mail written notice by certified mail, return receipt requested, or deliver it personally, by that deadline to KC Pickleball LLC doing business as Agora KC, 12444 Grandview Road, Grandview, Missouri 64030, stating that you wish to cancel. Sundays and legal holidays are excluded from this statutory period.
All payments and any related negotiable payment instrument must be returned within 30 days after receipt of cancellation notice; Agora's faster refund service standard still applies. Death or permanent disability preventing substantial use for at least 60 consecutive days permits cancellation, with a refund equal to contract price divided by contract weeks, multiplied by remaining weeks. Temporary disability permits a term extension for lost time. A mutually acceptable doctor's examination may be required. These rights cannot be waived.
Applicable rights concerning closure, relocation, prepayments, disability and cancellation remain protected.
9 Membership benefits
Benefits begin with actual access and apply only to your selected tier. Discounts do not stack; the single best eligible discount applies. Benefit redemption follows this section and Section 10.
Pioneer benefits
| Benefit | Pioneer 6 month initial term | Pioneer 12 month initial term |
|---|---|---|
| Open play | Included during eligible scheduled sessions | Included during eligible scheduled sessions |
| Included leagues | 1 league | 2 leagues |

Pioneer initial-term league credits are issued when access starts: one for the six-month option or two for the twelve-month option. They cover the named member's individual registration in an eligible Agora league during that initial term. After the initial term, continuously maintained month-to-month Pioneer membership receives one league credit at the start of each succeeding six-month benefit period and one clinic credit at the start of each succeeding three-month benefit period. These benefit periods do not create a new minimum commitment. Membership must be active when a benefit is redeemed. Tournament discounts are stated before each eligible event's registration.
Benefit periods and discounts
Clinic quarters are consecutive three-month membership periods beginning on the Access Start Date, rather than calendar quarters. One included group coaching clinic is available per period; the six-month Pioneer initial term therefore includes two clinics. Eligible clinic formats and skill levels are identified before registration. Discounts apply to eligible Agora-operated services and pro-shop merchandise; they do not apply to gift cards, prior purchases or independently billed partner services unless expressly included. Discounts do not stack; the best eligible discount applies.
Partner services follow the participating business's offer and terms. Participation and available offers may change. Future services are included only when announced as part of your tier's offer.
10 Booking and benefit use
Bookings follow published schedules, capacity, skill or activity eligibility and facility rules. Open play is subject to its session schedule and capacity. League priority provides an earlier enrollment window; it does not guarantee a preferred league or time.
Included league credits cover one individual entry in an Agora-operated recreational league identified as eligible in ClubCloud; skill, age and registration deadlines still apply. Pioneer court rentals and open-play sessions may be booked seven days ahead through ClubCloud. Court rentals are limited to two hours per member per day and two upcoming court reservations at a time. Published peak times are eligible unless a court is unavailable for an event or other existing reservation. Open play requires registration for the scheduled session and check-in; capacity and session rules apply. Founding booking privileges are specified in Section 15.5.
Unused court hours expire at the end of their membership month; clinic credits expire at the end of their three-month period; Pioneer initial league credits expire at the end of the initial term and renewal league credits at the end of their six-month benefit period. No cash value or rollover applies except when Agora cannot provide the benefit. Cancel court, open-play or clinic bookings at least twelve hours before start to restore the applicable credit or receive a refund of a separately prepaid booking. League cancellation deadlines are disclosed before registration. Later cancellations or no-shows forfeit the reserved credit or prepaid booking charge, with no additional monetary penalty. After three late cancellations or no-shows within thirty days, advance booking may be suspended for seven days following notice; eligible walk-in access remains available.
If Agora cancels a booking, it restores the benefit credit or refunds the separate booking payment. A credit that would otherwise expire is extended for thirty days. If Agora cannot offer a reasonable opportunity to redeem an included benefit within its period, it provides a thirty-day benefit-only redemption extension without requiring membership renewal; if still unavailable, Agora offers an equivalent benefit only with your agreement or a credit/refund based on the published standalone price. Guests must check in, meet activity eligibility and complete the required waiver; minors also require the required guardian consent and supervision. Guest admission or activity prices are disclosed before a separate purchase. Founding guest passes follow Section 15.5.
11 Facility rules and service interruptions
Follow Agora's reasonable safety, conduct, check-in and equipment rules. We may restrict access immediately for an immediate safety concern. Continuing suspension or termination follows the terms below and applicable law.
Agora may impose an immediate safety suspension and will provide the reason and duration in writing within two business days. You may request management review by email; we will respond within five business days. If Agora ends membership, access ends on the stated date, future dues stop and unused prepaid membership time is refunded proportionately without a voluntary early-cancellation fee. Separately incurred, authorized purchases or legally recoverable property damage remain separate; unused dues are not automatically forfeited. Agora will not terminate an otherwise compliant Pioneer membership solely to avoid honoring its Protected Rate.
A material service interruption occurs when regular member play is unavailable for seven consecutive days. Agora then credits all affected days from the first unavailable day and extends affected benefit periods; prepaid annual terms receive the equivalent extension or, at the member's choice, a daily prorated refund. If the interruption continues for thirty consecutive days, you may cancel without an early-cancellation fee and receive unused prepaid membership dues. Short scheduled closures disclosed in advance do not trigger this policy unless the threshold is met. Any earlier or greater statutory closure, relocation or service-failure remedy remains available. Silence does not constitute acceptance of a substitute location or material change.
Physical activities involve injury risks. Participate within your abilities, follow safety rules and stop when unsafe. A separate activity waiver is required before participation; this Agreement does not replace it or waive nonwaivable rights.
Agora will provide the separate participant waiver and applicable facility rules before participation. Activity-specific terms are provided before the relevant purchase or participation. This Agreement does not itself serve as an activity waiver.
12 Privacy and communications
Our Privacy Policy governs membership, contact and transaction information: https://agorakc.com/policies/privacy-policy. Service providers process information needed to administer membership and payments. Independent partners may require separate accounts or terms.
We send service notices about opening, billing, access, reservations, material changes and cancellation to your account contact details. Marketing consent and preferences are handled separately.
13 Agreement acceptance and changes
This Agreement, including Section 15 for Founding, your selected plan, order confirmation and expressly accepted written amendments govern your membership. A specific amendment controls only the subject it changes. Merchandise-return policies do not govern membership refunds.
We may adjust reasonable operating procedures with notice. Website or operating-rule changes do not remove paid benefits or alter your Protected Rate, initial commitment or cancellation rights. Material changes requiring consent will be presented for affirmative acceptance. Added benefits do not authorize added charges.
Missouri and applicable federal law govern. Nonwaivable protections prevail over conflicting terms. If a provision is unenforceable, the rest applies to the extent permitted by law. Contacting Agora about a dispute does not waive other available remedies.
Affirmative checkout acceptance or your signature records consent to this Agreement and the disclosed payment authorization. Browsing, joining an updates list or asking about membership does not create a purchase.
Your purchase record identifies the member, plan, amount paid, recurring amount and frequency, initial commitment, acceptance date and time, and agreement version. We provide the accepted Agreement and confirmation when the contract is made. Your activation notice supplies service dates and billing details. Additional copies are available on request.

15 Founding Membership
15.1 Purchase and membership term
| Plan detail | Founding membership |
|---|---|
| Initial service term from access | 12 months |
| Total first-year payment | $5,199 paid in full |
| Taxes and processing | Included; no additional mandatory membership fees |
| Membership payment due during presale | $5,199 |
| Application of presale payment | Your first full twelve-month membership term |
| Additional membership charge at opening | $0 |
| Renewal after the first service year | Only with your affirmative authorization; no automatic charge |
Your payment covers the first twelve months of Founding Membership in full. There is no separate activation fee. The term and benefit allowances begin with actual member access; no membership time is used while you wait and no additional membership dues are charged during the prepaid term. Optional services, bookings and upgrades remain additional only when separately purchased and authorized.
Founding activation requires the Pioneer core facilities described in this Agreement, plus the member lounge, functioning lockers and showers, and the designated Founding parking arrangement. Regular Founding-only open play must be available on a published schedule. If a required facility or benefit is unavailable, Founding does not activate unless you expressly accept a written temporary arrangement specifying substitute access and a credit or extension. Otherwise, the prepaid term has not begun and the full presale refund remains available.
Agora will provide at least seven calendar days' notice of the Access Start Date and the first twelve-month term's end date. A tour, preview, payment, platform date or account status does not itself start the term. This Agreement's March 1, 2027 outside access deadline and presale refund protections apply.
The term ends immediately before the first anniversary of the Access Start Date. For a February 29 start, the first-year end date is the last day of February in the following year. Monthly and quarterly benefit periods follow the anniversary-date rule in this Agreement.
15.2 Cancellation and refunds
Before the Access Start Date, you may cancel for a full refund of the entire $5,199 presale payment, without an early-cancellation fee.
After access begins, you may voluntarily cancel by emailing ask@agorakc.com or using a notice channel in this Agreement. Cancellation takes effect when your request is received, unless you ask for a later date. Access and unused benefits end on the effective cancellation date. Staff processing delays do not postpone the effective date.
Agora refunds the unused portion of your prepaid membership, calculated by multiplying the membership amount paid by the number of unused days remaining and dividing by the total days in your paid twelve-month term. The effective cancellation date is included among unused days when access ends that day. The voluntary early-cancellation fee is the lesser of $150 or that unused prepaid balance and is deducted from the refund. The refund cannot be negative, and no additional future membership dues are owed. Already-authorized optional purchases remain separately payable.
Agora will acknowledge refund requests within two business days and initiate refunds within five business days, normally to the original payment method, while ensuring any applicable thirty-day legal refund deadline is met. Agora absorbs processing fees. These service-standard business days are Monday through Friday excluding federal holidays. Required penalty-free cancellation, disability, closure and other statutory remedies take priority over the voluntary fee and daily-proration method; no voluntary cancellation fee applies when a penalty-free remedy is required.
Voluntary membership freezes are unavailable. Applicable cancellation, refund, disability and accommodation rights remain protected. No rights in this Agreement's BUYER'S RIGHT TO CANCEL provision are waived by these Founding terms.
15.3 Renewal and payment authorization
Before your twelve-month term ends, Agora will provide your renewal options, pricing and terms. Renewal requires your affirmative authorization. No annual renewal payment is collected automatically, and silence or a stored payment method does not authorize renewal. If you do not renew, membership ends at the paid term's end. Founding Membership does not include Pioneer's protected monthly rate or a guaranteed future Founding renewal price.
Your initial payment authorization covers only the stated $5,199 first-year payment. No recurring dues are collected before access or during that prepaid year. Separate optional purchases and any later renewal require their own authorization. Agora KC remains in development; no opening date is promised.
15.4 Founding benefits
The following benefits apply during your paid Founding membership year. Benefits and partner offers added to this tier apply only under their announced terms. Partner services and premium upgrades are not automatically included at no charge. Discounts do not stack; the single best eligible discount applies.
| Benefit | Founding entitlement |
|---|---|

| Included leagues | 1 league per published five-week league cycle |
| Additional leagues | 50% discount |
| Coaching | 50% discount |

| Guest passes | 36 per 12-month membership year from actual access |
| Included court rentals | 4 total court-hours per month, regardless of player count |
| Additional court rentals | 50% discount |
| League enrollment priority | 1 week before general enrollment |
| WiFi and arcade access | Included |
| Agora-sponsored tournaments | Free entry to all Agora-sponsored tournaments |
| National events hosted at Agora | A free ticket to each national event hosted at Agora |
| Founding open play | Access to Founding-member-only open-play times |
| Parties and events | 20% discount |
| Pro shop | 15% discount |
| Member events | Access to exclusive member events under published event terms |
| Participating partner offers | Published member offers |
| Member amenities | Access to the lounge, lockers and showers |
| Welcome gift | Agora swag bag |
| Parking | Designated parking spot |
15.5 Benefit periods and reservations
One included individual league entry is available per published five-week league cycle. If access begins mid-cycle, you may join an eligible league with space and organizer approval or use the next full cycle; no duplicate credit is created for the same cycle. Included tournament entry covers standard individual registration in each eligible amateur division at Agora-sponsored tournaments, subject to skill, age and registration rules. Independently charged association dues, optional merchandise and professional divisions are excluded unless expressly included.
Each national event hosted at Agora includes one general-admission spectator ticket or pass for the Founding member covering the event's standard spectator sessions; guest tickets, VIP upgrades, food and travel are additional. Claim instructions and a deadline are sent to your account email at least seven days before that deadline. Founding-only open-play sessions are identified in ClubCloud and published before their booking window opens; registration, check-in and capacity rules apply.
Founding members may book court rentals and open-play sessions fourteen days ahead through ClubCloud. Court rentals are limited to two hours per member per day and two upcoming court reservations at a time. The four included court-hours reset on each monthly anniversary, may be booked in thirty-minute increments, and may be used during published peak and off-peak times when courts are available. One court for one hour uses one court-hour regardless of player count. A court reservation admits its playing group of up to four people for that reservation; guest passes are not required for those players, but check-in and waiver requirements apply.
All 36 guest passes are issued at activation for the twelve-month membership year. One pass covers one accompanying guest for one scheduled open-play session. The Founding member must attend; up to three guests may use passes on one visit, and repeat guests are allowed while passes remain. Passes do not cover leagues, clinics, tournaments or separately booked services. Guests must satisfy eligibility and waiver rules. Unused passes expire at the end of the paid membership year and have no cash value or rollover.
One included group coaching clinic is available in each consecutive three-month membership period from the Access Start Date. Eligible formats and skill levels are identified before registration. Unused quarterly clinic credits and monthly court hours expire at the end of their period. League entries follow their five-week cycle. Cancellation, credit restoration and Agora-cancelled activity remedies follow Section 10 of this Agreement. No additional monetary late-cancellation or no-show fee is imposed.
15.6 Member amenities
A designated parking space is assigned for the Founding member's use while visiting Agora. It is not transferable, is not overnight vehicle storage and does not override accessible-parking requirements. Lockers are for day use, subject to availability; remove belongings at the end of the visit. Membership does not include an individually assigned storage locker. The member receives one Agora-branded welcome bag at the first member check-in; contents may vary and no particular retail value or cash substitution is promised.
The coaching, court-rental, party/event and pro-shop discounts in the benefits table apply to eligible Agora-operated services and merchandise. They do not apply to gift cards, prior purchases or independently billed partner services unless expressly included. A discount never makes an otherwise separately priced service automatically free.
15.7 Service interruptions and agreement acceptance
This Agreement's remedies apply when regular member play is interrupted. If an included Founding core amenity becomes unavailable for seven consecutive days while member play continues, Agora will offer a written substitute benefit, credit or extension for your acceptance. If the material amenity interruption continues for thirty consecutive days without an accepted remedy, you may cancel without a voluntary early-cancellation fee and receive the daily prorated unused prepaid balance. Earlier or greater rights required by law remain available.
Affirmative checkout acceptance or your signature records agreement to these Founding terms together with the common provisions of this Agreement. An inquiry alone does not purchase or reserve membership. Your purchase record identifies the member, Founding plan, payment, term, acceptance date and time, and Agreement version. Agora provides the accepted Agreement and payment confirmation when the contract is made.
